OSCAR Terms of Service

These terms cover the OSCAR account, OSCAR Pro, and the OSCAR relay that serves public surfaces (together, "the service"). They are an agreement between you and the OSCAR project ("we", "us"), at https://www.createwithoscar.site. By creating an account or using the service you agree to them.

The OSCAR application itself is open source. Its licence (BSD 3-Clause) is in the application's repository and governs your use of that code. Nothing here takes away rights that licence gives you.

1. Your account

You can sign in with Google, with Discord, or with your email address. You are responsible for what happens under your account and for keeping access to it secure. You must be old enough to agree to these terms where you live, and at least 13.

One account is for one person or one organisation. Do not share an account to get around the limits of a plan.

2. Plans

The Free Tier costs nothing. OSCAR Pro adds features, which may change over time; we will not remove a feature you have paid for during the period you paid for without offering a fair alternative or a refund for the unused part.

Some features may be offered free for a limited time, including the relay. We will say so where they are offered, and tell you before that changes. The free trial of OSCAR Pro is described in section 3.

OSCAR Pro is proprietary software licensed to you, not sold, for use with your account for as long as your plan lasts. You may not resell it, remove its licence checks, or share plan files or activation files with people outside your organisation.

3. The free trial

We may offer a free trial of OSCAR Pro. At the time of writing it is 30 days, for the first 500 accounts.

• It is limited. One trial per person or organisation. The number of trials, their length and what they include are set by us and may change for accounts that have not yet started one.
• It is at our discretion. Whether an account qualifies is our decision. We may decline, limit, suspend or end a trial at any time and without notice, for example if we believe an account was created automatically or by a bot, is one of several made to get more than one trial, is being used to abuse or overload the service, or if we do not have the capacity to serve it. Signing in does not by itself entitle anyone to a trial.
• Nothing is charged. A trial asks for no payment details. When it ends the account returns to the Free Tier by itself. Schedules and public surfaces you set up stay in your project, and stop running until the account has a plan that includes them.
• The trial is provided as it is, like the rest of the service (sections 8 and 9), and the limits of the relay (section 4) apply to it.

4. Public surfaces and the relay

The relay lets you make a surface reachable from the internet. You decide what is on it and who gets the link.

• A public surface can be opened by anyone who has its address. Do not put confidential information on one.
• You are responsible for what your public surfaces show and for what they control.
• The relay has limits on visitors, message rates and page size, which are published with the product and may change. We may pause a surface that exceeds them.
• The relay is provided on a best-effort basis. It depends on the internet and on third parties and will sometimes be slow or unavailable.

5. Acceptable use

Do not use the service to break the law, to infringe other people's rights, to distribute malware, to harass anyone, to collect visitors' personal information without their knowledge, to attack or overload the service or anybody else's systems, or to get around its limits. We may suspend or close an account or a public surface that does, and will tell you why unless the law prevents it.

6. Safety

OSCAR sends control signals to lighting, sound, video and other equipment. It is not designed or certified for safety-critical use. Do not use it as the only means of controlling anything where a failure, a delay or a wrong value could cause injury, death or serious damage, including pyrotechnics, moving machinery, rigging and life-safety systems. Always have an independent way to stop the equipment. You are responsible for your installation and for the people around it.

7. Your content

Your projects and surfaces are yours. You give us permission to store and serve a surface you make public, for the sole purpose of showing it to the people you send its address to. That permission ends when you make it private.

8. No warranty

The service is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the service will be uninterrupted, timely or error-free.

9. Limit of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or show time. Our total liability for any claim about the service is limited to the amount you paid us for it in the twelve months before the claim, or 50 US dollars if you paid nothing.

Nothing in these terms limits liability that cannot be limited by law, or rights you have as a consumer that cannot be waived.

10. Ending

You can stop using the service and ask us to delete your account at any time. We may end or suspend your access if you break these terms, or stop offering the service with reasonable notice; if we stop offering a paid plan we will refund the unused part. Sections 6, 8 and 9 continue to apply afterwards.

11. Changes

We may change these terms. We will post the new version at this address with a new date, and tell account holders by email if the change is significant. If you keep using the service after a change takes effect, you accept it.
